TERMS & CONDITIONS

 

Booking your Holiday

  • Your contract in relation to your vacation is made with PT. Wisata Nusantara Gemilang or Bali Best EO (the Company), is registered in Indonesia and all bookings are subject to these terms and conditions.
  • All communications by the Company in relation to your holiday will be sent to the address indicated on the booking form.
  • All orders must be made through an authorized representative of the Company. At the time of ordering the Company's order form must be completed and submitted together with a deposit of 50% of the total cost of the order.
  • Acceptance of the deposit and order form by the Company does not guarantee or imply confirmation of the order. Orders will not be confirmed until the Company issues written notice. The company reserves the right to refuse the order without giving any reason and in this case will refund the deposit received.
  • Your vacation must be paid in full at least 30 days before the departure date. If payment is not received by the due date, the Company reserves the right to cancel the order and retain the deposit. The person who signs the order form guarantees payment of the total amount stated on the order form in accordance with these conditions. It is the responsibility of the signatory to ensure that the Company receives payment in full by the due date. No reminders will be sent.
  • If you book within 30 days from the date of departure, payment must be made in full at the time of booking.
  • All special requests, such as dietary requirements, must be noted on the order form.
  • The company will provide services as specified and confirmed in writing.

 

Price Policies

  • The company is under no obligation to provide details of the costs involved in the holiday.
  • Once the Confirmation Invoice is issued, unless you choose to pay for your holiday in full at the time of booking, the price of your holiday will be charged the possibility of surcharges in certain limited circumstances. However, additional fees will only be charged to allow for variations in transportation costs, including fuel costs, increases in normal airfare issued, taxes or fees charged for services such as airport landing taxes, the exchange rate applied to certain packages, or if the government or regulatory agency imposes a tax increase. Even then, the Company will absorb an amount equal to 2% of your holiday price (excluding insurance premiums and amendment charges) before passing on any surcharge to you. Only amounts in excess of this 2% will be surcharged. Additional charges will be notified via a revised Confirmation Invoice sent to you.
  • The company reserves the right to notify you of any price increases prior to accepting your order.
  • If a surcharge would increase the total holiday price shown on your original Confirmation Invoice by 10% or more, you may cancel your booking within 14 days of the date of issue of the revised Invoice and obtain a full refund of all payments made to the Company and any previously incurred amendment fees.
  • Optionally, you may choose to pay for your holiday in full at the time of booking, in which case the price of your holiday will be set at the cost quoted by the Company at the time. To be eligible for this benefit, you must return the Confirmation Invoice to the Company with full payment to reach the Company within 7 days from the date printed on the Confirmation Invoice.
  • The financial commitments offered above by the Company mean that the Company is not able to reduce the holiday prices should the value of the Indonesians Currency strengthens.

 

Cancellations and Changes by the Company

  • Sometimes it may be deemed necessary to make changes to your holiday and the Company reserves the right to do so at any time, and you will be notified of any changes at the earliest opportunity. If major changes to your tour are required, provided that they do not arise from circumstances beyond the control of the Company, you may choose (i) to accept the change of arrangements (ii) to purchase another holiday from us or (iii) cancel the holiday. Compensation may be paid in the event of a major change as described below.
  • No compensation will be paid for minor changes. Minor changes include minimal changes to departure and arrival times, changes to the type of aircraft used, and changes to restaurants and accommodations to comparable or superior standards.
  • Major changes include cancellations, changes to your UK airport, delays in departure or returns of more than 12 hours and changes to accommodation to a lower standard of accommodation.
  • No compensation will be paid for changes or cancellations caused by Force Majeure, war, the threat of war, riots, civil strikes, industrial disputes, terrorist activities, natural or man-made disasters, fires, technical problems for transportation, closures or airport congestion, strikes or other industrial actions, adverse weather conditions or other events beyond the control of the Company. It is important that you take out adequate travel insurance.
  • The company reserves the right to cancel your vacation at any time prior to the departure date, even after a confirmation notice has been sent. If your vacation is canceled, the Company will refund the full amount you paid. No compensation will be paid.
  • Transportation is subject to the carrier's conditions of carriage, some of which may limit or exclude liability. These terms are often the subject of international agreements between countries and a copy of the terms, which apply to your holiday trip, will usually be found on airline tickets.
  • If you fail to pay the remaining holiday price at least 30 days before departure, the Company will treat the booking as canceled and collect the cancellation fee set out below
  • The company also reserves the right to refuse any person as a member of the tour, if they think that person may endanger the health, safety and enjoyment of others on the tour. In any of the above-mentioned events, the company's sole liability and the client's sole remedy will be limited to the refund paid, minus the number of services used plus administrative fees.

 

Cancellations and Changes by You

  • You may cancel your holiday at any time provided you notify the Company in writing. The following fees will be charged for each cancellation:
  1. 30 days or more 50% of Deposit
  2. 15 – 30 days 100% of Deposit
  3. 8 – 15 days 80% of Tour Cost
  4. 1 – 7 days 100% of Tour Cost
  • Once the itinerary is confirmed, the client is allowed free of charge for the administration of a set of amendments, although will be responsible for any additional costs that may be added to the tour, including airline charges, hotels etc. Any further modifications, which are instigated by the client, will incur a charge of 20 US dollars due to communication and administration expenses that may have been incurred.

 

Our Responsibilities

  • The Company does not own or manage the aircraft, accommodation, restaurants, and other facilities used in connection with the arranged tours. Although the Company has been careful in selecting providers of travel services, accommodation, restaurants and other facilities, the Company has not had the opportunity to inspect and does not state that the aircraft, accommodation, restaurants, and other facilities and services have been inspected.
  • The Company is not liable if you or any member of your party suffers death, illness or injury as a result of failure to perform or improper performance of any part of our contract with you where such failure is caused by (i) acts and/or omissions a member of a party, or (ii) a third party unrelated to the terms of your vacation, or (iii) an event that the Company or its service providers could not have foreseen or prevented even with due care.
  • If any member of your party suffers illness, injury or accidental death arising from an activity, which is not part of the vacation the Company has arranged for you, the Company cannot accept responsibility. The company will offer general assistance if needed.
  • The company regrets that no refunds will be made on unused tickets for travel, sporting events or other types of tickets unless a refund can be obtained from the operator or provider.

 

Your Responsibilities

  • You are responsible for arranging your own travel insurance, although a suitable policy may be included in your tour package. Details of all insurance policies held by each member of your party must be provided on the order form. Order forms cannot be accepted without sufficient evidence that a privacy policy has been set up. Please ensure that your insurance coverage applies to the specific activity you booked and confirmed on the Confirmation Invoice.
  • Each member of the group must have a passport, visa and all necessary documents for the country they are visiting. The company is not responsible for any delays or expenses if your documents go wrong.
  • It is your responsibility to check in for flights in a timely manner and show yourself to collect all pre-booked components of the holiday. The company cannot accept responsibility for clients who miss flights due to late check-in and no credit or refund will be issued if you fail to take any component of your holiday. Refund credits will not be issued for lost, lost or damaged travel documents.
  • By booking a vacation with the Company, you promise to behave in an orderly manner and not to interfere with the enjoyment of others who are vacationing with you or do anything that could damage the reputation of the Company. If you violate this clause, your vacation will be terminated immediately and the Company will no longer have any contractual obligations to you. The company has the right to obtain compensation from the infringing party and/or the person who signed the order form for any damage caused.
  • It is the responsibility of the person signing the Order Form to disclose any pre-existing medical conditions that their party member may have.
  • All equipment and personal belongings must be at all times and in all circumstances at the owner's risk. The company cannot accept responsibility for loss of or damage to or delay in your baggage or goods unless directly caused by the negligence of one of our representatives.

 

Smoke

  • The Company prohibits smoking in vehicles operated by the Company. Quitting can often be arranged for those who wish to smoke. All accommodation will be booked with a smoking room unless the client specifically requires a smoking room. Confirmation is subject to hotel availability.

 

Waiver

  • The company will endeavor to ensure the safety of clients during the tour, however, any aspect of any particular tour should not be without an element of danger. Clients should be prepared to sign a 'Disclaimer of Liability' form before they start their tour. This form is an understanding that all clients need to exercise judgment and care at all times to ensure the safety of themselves and their fellow travelers.

 

Disclaimer

  • The company has made all reasonable efforts to check the accuracy of the information contained on our website. However, the Company cannot accept any responsibility for errors or commissions that may appear on this site.

 

Complaints

  • If you have a problem during your vacation, please immediately notify the relevant airline, hotel, and local agency of other suppliers so that they can try to fix it. If you are unable to resolve the issue, you should contact the Company's office so that they are given an opportunity to assist. The company will not be held responsible for the non-performance of the itinerary through causes beyond their control or when they are not notified of the problem at the point where corrective action can be taken. If the complaint cannot be resolved by that time, you must write to the Company within 28 days of returning home, providing your original booking reference number and all other relevant information. If you fail to take any of these steps, you will hinder the Company's ability to resolve the issue and/or investigate it fully and any rights you may have to receive compensation will be reduced or completely nullified.
  • Any dispute that may arise will be governed by the laws of Oman and both parties will submit to the jurisdiction of the Indonesian Courts.
  • All information provided by the Company both in writing and orally is to the best of the knowledge of the Company and is believed to be correct at the time given and given in good faith. The terms of the order must take precedence over any warranties or other conditions that may have been provided.

 

Data Protection Act

  • The company may need to ask you for certain personal information. Examples are dietary requirements, disability/medical or religious information, etc. This information will be kept confidential by the Company and available for you to check during normal Company business hours. This will be passed on to the supplier, if it is necessary for them to know this information in order to fulfill the Company's contract to you.
